Pricing Errors and Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or an error in pricing or product information, Central Ohio Paintball shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Central Ohio Paintball shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Central Ohio Paintball shall issue a credit to your credit card account in the amount of the charge.

Substitution of Items and Back Orders

We reserve the right to substitute paintball color if the the ordered color is unavailable.  We may, out our discretion, substitute like-kind-items where a brand is considered a commodity item.  In the event of a back order situation, we will use our discretion to process an order and release the order in a timely fashion.  This may include an order being shipped incomplete or a delay in processing if we are shipping it complete.  We make an effort to contact customers in the event of a backorder situation. 

Disclaimer and Limitation of Liability of Products Sold

Except as expressly stated herein, Central Ohio Paintball, Inc. makes no representations or warranties, either express or implied, of any kind with respect to products sold on the Central Ohio Paintball sites. Except as expressly stated herein, Central Ohio Paintball, Inc. expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to Central Ohio Paintball, Inc. arising from any product sold on the Central Ohio Paintball sites shall be the price of the product ordered. In no event shall Central Ohio Paintball, Inc., its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to product sold.

Local, State, Federal, Laws on Products

It is the responsibility of the buyer, not the seller, to ascertain and obey all applicable local, state, federal, and international laws in regard to the possession, use, and sale of any item purchased from Central Ohio Paintball. By placing an order, the buyer represents that the products ordered will be used only in a lawful manner and that he/she is of legal age.

Central Ohio Paintball, Inc. makes no representations or warranties, either express or implied, of any kind with respect to the Central Ohio Paintball sites, their operations, contents, information, or materials. Central Ohio Paintball, Inc. expressly disclaims all warranties, express or implied, of any kind with respect to the sites or their use, including but not limited to merchantability and fitness for a particular purpose. You agree that Central Ohio Paintball, Inc., its directors, officers, employees or other representatives shall not be liable for damages arising from the operation, content or use of the Central Ohio Paintball sites. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages.

Contact Policy

While processing your order, we may need to contact you by phone or e-mail.  You agree to provide us with good contact information to ease this process.  Also, when you set up your account, we collected your e-mail address.  We may contact you with product information, special sales and other relevant news and information from time to time by e-mail.  For your convenience, our e-mail list server will allow you to opt out of this list at any time.  Your personal information is never sold or shared with other parties.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Central Ohio Paintball reserves the right at any time after receipt of your order to accept or decline your order for any reason.  All orders must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance and customer service department. We may require additional verifications or information before accepting any order.

Sales Taxes

Central Ohio Paintball shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Ohio. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.

Jurisdiction and Venue

You agree that the laws of the State of Ohio shall govern any legal action brought against CENTRAL OHIO PAINTBALL INC. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Central Ohio Paintball sites shall be an appropriate federal or state court located in Franklin County, Ohio.
